By commissioning me, you agree that you have read and accepted all the terms described herein. If the BUYER breaks any of the rules stated on this page then they will lose all the rights to the commissioned work by me and I, Jojuki/Kitju, can use said piece according to what I see fit. If that buyer has any problems with these terms, it can be discussed privately.

 

General Terms:

• I have the right to reject any commission that I do not feel comfortable doing.

• Prices are subject to change anytime.

• Please note that all of my sales are "Digital Artwork", not "Physical Artwork".

• NFT usage and AI usage of any kind is not allowed under any circumstances.

Payment:

• I accept Paypal and Venmo only. For other methods, please discuss with me. Currency accepted is USD.

  •  The Paypal/Venmo fee is not included in the price.

• Commissions can be paid in full or 50% upfront and 50% after I finish.

• DO NOT send me payment before I agree to your commission. I will be sending you an invoice instead.

• I don't start your commission until I get at least half payment.

  • ​I'll need full payment before I present to you your final commission.

Rush Fee

• Rush fees are at least + 25%+ of the commission. Fees might vary depending on the project and the timeframe provided.

• However, in some cases, I am able to accept a rush commission that would bring your queue up forward significantly.

•  Dates provided are subject to change, details are to be discussed should the client have set dates.

Refund/Cancellation:

• Partial refunds are allowed until I am past the sketch phase.

• If I am unable to finish your commission for any reason, I will issue a partial or full refund depending on the situation.

• You can get a full refund if you cancel your commission before I start.

• DO NOT issue a Paypal chargeback; I will send you back the money.​​

• Purposefully issuing a chargeback without contacting me to cancel/refund a project will result in immediate blacklisting for you as well as your email address, and anyone sharing your PayPal account, including side accounts.

Process:​

• I will message you when I start and once I move past the sketch phase, there are no refunds allowed.

• I will show you the sketch before I line if you request for it.​

• Turnaround time can take anywhere from 1 week to 4 weeks+; if you'd like a quick turnaround, that might be possible depending on my schedule but you will be charged accordingly.

• Please be patient with me as I may be slow.

• I do a maximum of 3 characters on a canvas unless under special circumstances.

• Fill out the order form if you want to commission me. A full body coloured reference is preferred.

• I will not give a full refund if you aren't satisfied but I will discuss/change/edit your commission. However, I will not completely redo your commission.

• Once I finish your piece(s), I will send you the full resolution (.png for transparent imgs. and .jpeg for solid bgs) either via email or whichever you prefer.​

Revisions:​

• Any revision will require a fee unless it was a mistake on my part. ​​Any changes to the character or subject will be subject to a fee, and the fee will depend on the nature of the change.

  • Fees can range anywhere from $1-$50+​ depending on how long it will take me and how far along I am in the process of your commission.

• I am not responsible for any unsatisfactory element of the finished design if no feedback was given to amend it.

• I will only send a guaranteed WIP for the Sketch, but you are free to request a WIP at any given time

•  I will not redraw a completed commission unless payment is received for a second order.​

Copyright/Usage Policy:

• I reserve the rights to my artwork; don't edit them or redistribute for commerce purposes.

• My work is for NONCOMMERCIAL/PRIVATE USE ONLY unless otherwise specified by the commissioner.

  • Commercial work is priced differently.​

•  I reserve the right to decline any project or client for any reason.

• The user is allowed to use the artwork for:

  • personal purposes​ such as printing it out for themselves

• The user cannot:

  • claim they made the artwork​

  • use the artwork for commercial purposes unless otherwise stated (this includes use the artwork to promote themselves like display it on a banner or use it in part of their business cards)

• Commercial use is usually DOUBLE or more to the original price. Please discuss this with me privately.

  • The ARTIST shall retain all rights under copyright law to which the WORK, preliminary studies, drawings, specifications, and models may be subject. The ARTIST represents and agrees that the ARTIST is the sole creator of the WORK and that the WORK has not been previously displayed in whole or part, and that nothing in the WORK will infringe the copyright of any third party. Nothing shall prevent the ARTIST from creating future artwork in the ARTIST'S manner and style of artistic expression. FOR THE AVOIDANCE OF DOUBT, THE ARTIST GRANTS SOME RIGHT(S) OF REPRODUCTION SUCH AS COMMERCIAL USE ON BANNERS, ADVERTISING, AND MARKETING.​

  • In the case of artwork use as a product, the BUYER must pay a certain amount of royalties or a flat rate which will be discussed and agreed upon.

NDA - Privacy Request

• If you wish for your request to be private, it must be stated during the ordering process.

• I reserve the right to charge a fee if I deem fit.

• The privacy request entails that I am not allowed to share any WIPs on social media, nor am I allowed to stream the process of the commission anywhere.

• However, this also means that you must refrain from sharing any such spoilers yourself.

Final Product

• There may be slight differences between the samples in my gallery and the illustration you will receive.

• The commissioner must respect that my artistic style cannot be altered.

•  Any file you paid for will be available from me for a finite time only. I take measures to preserve most files for up to 3 months. However, I cannot guarantee against computer failure or accidental deletion or loss.

• YOU WILL RECIEVE: (unless otherwise stated)

  • full resolution of the artwork as a .png file.​

  • a watermarked version of the artwork as a .png file and a two layer .psd file (first layer is the watermark and second layer is the artwork)
